Landlords in Poland are entitled to compensation from the Polish Government

The special-purpose act on combating the effects of COVID-19 has significantly limited the possibility of conducting business activity in facilities over 2,000 sq m and has exempted tenants of commercial areas from the obligation to pay rent. The aforementioned regulations resulted in depriving owners of commercial facilities of income from lease and the possibility to use their assets. In the latest article in Dziennik Gazeta Prawna, experts from BSJP law firm emphasize that owners of shopping malls are entitled to compensation from the State Treasury for losses incurred as a result of restrictions implemented by the Anti-Crisis Shield. Our lawyers also point out that the restrictions in question are in contradiction with the Constitution of the Republic of Poland.
