Use of someone else's registered trademark - ruling of the CJEU

In a product commercial, one may use the image of someone else's registered trademark, provided that such use is justified by way of, for instance, explanation. If this is the case, the aforementioned use falls into the framework of the right to make citations, as ruled by the CJEU on 27 September 2017.

Katarzyna Kwestarz comments on the ruling in Dziennik Gazeta Prawna.
