Information on the processing of personal data of EMPLOYEE CANDIDATES

1. CONTROLLER

The controller of your personal data is BSJP Brockhuis Jurczak Prusak Sroka Nilsson sp. k. with its registered office in Warsaw, registered in the register of entrepreneurs of the National Court Register under number KRS: 0000059648 (hereinafter referred to as "BSJP" or the "Controller"). BSJP as the data controller decides for what purposes and how your personal data will be processed.

You may contact the Controller with regard to the processing of your personal data:

  • in person on at the Controller’s registered office.

3. YOUR PERSONAL DATA

We process the following personal data of yours:

  • name(s) and surname(s), date of birth, contact details, education, professional qualifications and data on the course of employment (Article 221 § 1 of the Labour Code);
  • and other personal data (e.g. image recorded on a photograph, information about disability), if provided by you. You are not obliged to do so, but sending us such data means that you have consented to the processing thereof for the purpose of recruitment.

The consent you have given by submitting the abovementioned (other) personal data may be revoked by you at any time. However, the processing of such data until your consent is withdrawn is lawful.

4. SOURCE OF PERSONAL DATA

We receive your personal data, which we collect and process, directly from you. What is more, your personal data may be provided to us by other controllers (e.g. Pracuj.pl, if you have created an account there, with the option to share your profile with employers).

5. PURPOSES, LEGAL BASIS FOR THE PROCESSING AND STORAGE PERIOD OF YOUR PERSONAL DATA

PURPOSE LEGAL BASIS STORAGE PERIOD

We process your personal data (referred to in Article 221 § 1 of the Labour Code) for the purpose of assessing your qualifications for a certain position and for the purpose of making decision on your candidacy and possible employment.

The legal basis is Article 6(1)(b) of the GDPR in so far as it shapes the basis for the processing of personal data at your request, prior to the conclusion of the employment contract.

Personal data of persons who have not been selected are not stored but shall be removed immediately after the recruitment process is completed and information about its completion is sent.

We process your personal data, which you are not obliged to provide, also for the purpose of evaluating your qualifications for a specific position and for the purpose of deciding on your application and possible employment.

The legal basis is your consent (Article 6(1)(a) of the GDPR and Article 9(2)(a) of the GDPR, whereas it can be expressed by simply sending said personal data to us.

You can withdraw your consent at any time in any way, including by sending a message to the addresses indicated in point 2 above. The processing of personal data until the withdrawal of consent is lawful.

Until you withdraw your consent to the processing of your personal data before or after the end of the recruitment process, in the event that you have not been selected for the position for which you applied.

We also process your personal data (referred to in Article 221 § 1 of the Labour Code) in order to evaluate your qualifications for a specific position in the future (future recruitment or when the recruitment was not announced, but you have sent us your CV).

The legal basis is your consent (Article 6(1)(a) of the GDPR and Article 9(2)(a) of the GDPR expressed by the inclusion of a proposed declaration (statement of consent) in your CV or by ticking a box (if any) in the job advertisement.

You can withdraw your consent at any time in any way, including by sending a message to the addresses indicated in point 2 above. The processing of personal data until the withdrawal of consent is lawful.

Until you withdraw your consent to the processing of your personal data, but no longer than 12 months.

6. RIGHTS YOU ARE ENTITLED TO IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA

Right of access
at any time, you can obtain knowledge on what personal data of yours is processed by the Controller and you can receive a copy of your personal data.
Right to rectification
if you notice that your personal data is incorrect or if, for example, your name, telephone number or e-mail address has changed.
Right to erasure
  • if your personal data is no longer necessary for the purposes for which it was collected by the Controller;
  • if your data is unlawfully processed;
  • if the erasure of the data is necessary for the fulfilment of the obligation resulting from the provision of law and incumbent on the Controller.
Right to restriction of processing
  • if you notice that your personal data is incorrect, you may request that it is not further processed during the period in which the Controller verifies its accuracy;
  • if your personal data is unlawfully processed but you do not want it to be erased;
  • the Controller will no longer need the data, but you may need it for the purpose of pursuing claims or defending against claims.

7. RECIPIENTS OF YOUR PERSONAL DATA

Your personal data may be made available to entities which provide services to us (e.g. suppliers and computer service technicians, software service technicians, couriers). In addition, your data may be made available to processors participating in the recruitment process (Pracuj.pl).

8. COMPLAINT TO A SUPERVISORY AUTHORITY

If you believe that your personal data is being processed unlawfully, you can lodge a complaint with the President of the Personal Data Protection Office (Office of the Personal Data Protection Office - ul. Stawki 2, 00-193 Warsaw).

9. PROVISION OF PERSONAL DATA

The provision of personal data on your part in order to participate in the recruitment process is voluntary. However, if you do not provide personal data (as indicated in Article 221 §1 of the Labour Code), you will not be able to participate in the recruitment process.

10. AUTOMATED DECISION-MAKING, INCLUDING PROFILING

We will not make automated decisions against you, which decisions would have legal effects on you or affect you in any similar way.
